How overtime pay works
Under federal law (the Fair Labor Standards Act), most hourly employees are entitled to 1.5x their regular rate for any hours worked beyond 40 in a workweek. This is the rule most states follow.
California — and a few other states (Alaska, Nevada, Colorado) — use daily overtime instead, which can entitle you to overtime pay even if your weekly total is under 40 hours:
- Over 8 hours in a single day: 1.5x pay for the extra hours
- Over 12 hours in a single day: 2x pay ("double-time") for hours beyond 12
- The 7th consecutive day worked in a week also gets special treatment in California — this calculator doesn't model that specific edge case, so check with your employer if it applies to you
Some employees are exempt from overtime entirely (certain salaried, executive, or professional roles) — this calculator assumes you're a non-exempt hourly employee, which covers the majority of hourly workers.
